If you get into a situation where you need to have a car towed from your property, it’s important to know that there are detailed regulations about towing from private property.
Many of these regulations are designed to protect the car owner, and if you’re found to be in breach of these, then you may be putting yourself at risk of being sued.
The first thing to be aware of is that a vehicle can only be removed from private property in Queensland by a licensed tow truck company like SEQ towing.
We are issued with our towing license by The Department of Transport and Main Roads. This is the body that regulates tow truck drivers to ensure they are not operating outside the regulations.
As tow truck operators, we are legally obliged to take reasonable steps to locate the driver. This will involve things like asking in places like shops or asking neighbours if they know the driver of the vehicle.
We would also be expected to check in and around the vehicle for signs of who the owner might be, and to see if there are any ways to get in touch with them before towing.
After we tow a vehicle, we also have to tell the police that the vehicle has been towed from private property. This is because most people will contact the police if their car is not where they expect it to be.
If the police are aware that the vehicle has been towed, they can let the owner know.
If a person has had their vehicle towed, they are likely to be angry. By ensuring you follow the right steps, such as using a licensed tow truck company and driver and making every effort to contact the driver before having their vehicle removed, you may not be sued.
There is still a chance of this if you choose to organise to tow a car that isn’t yours that you may be sued by the owner.
There could be many reasons why they’ve had to leave their car on your property and understandably, they will be stressed out by it not being where they expected it to be.
Explain what has happened, where their vehicle has been taken and how they can get it back.
